Mallard Brothers Construction, Olympia, Washington
Last updated: 10 September 2026
1. What this covers
This agreement governs use of the Mallard Project Dashboard application (“the Software”), internal software owned by Mallard Brothers Construction (“the Company”) and used to plan and track the Company’s own construction projects.
2. Who may use it
The Software is for the Company’s internal business use only. It is not offered to the public, not sold, and not licensed to anyone outside the Company. Permitted users are the Company’s owners and employees, and contractors acting on the Company’s behalf, each within the access their role allows.
3. What is permitted
Permitted users may use the Software to carry out the Company’s business.
4. What is not permitted
Users may not copy, distribute, sell, sublicense, or make the Software available to anyone outside the Company; use it for any business other than the Company’s; or attempt to use it to reach information they are not authorized to see.
5. Ownership
The Software and everything in it remain the property of the Company. Nothing here transfers ownership of it to anyone.
6. Connected services
The Software reads data from QuickBooks Online with the Company’s authorization, and does so on a read-only basis. Use of QuickBooks Online is governed by the Company’s own separate agreement with Intuit Inc., which this agreement does not alter, replace, or limit. Intuit is not a party to this agreement.
7. Company data
Information handled by the Software belongs to the Company. Its handling is described in the Company’s Privacy Policy.
8. No warranty
The Software is provided as is, without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. The Company does not warrant that the Software will be uninterrupted or error-free.
The Software is a planning and record-keeping aid. It does not replace the Company’s accounting records, its contracts, or professional judgment. Figures it displays should be verified against the underlying records before being relied on for a financial or contractual decision.
9. Limitation of liability
To the fullest extent permitted by law, no party will be liable for any indirect, incidental, special, or consequential damages arising from use of the Software.
10. Ending use
The Company may withdraw access to the Software from any user at any time. Access ends when a user’s employment or engagement with the Company ends.
11. Governing law
This agreement is governed by the laws of the State of Washington, United States.
